It's the outboard engine which must be replaced, so it affects the roll balance much more than the inboard engine would and probably cannot be properly compensated with fuel and trim.

Someone is reading far too much into this. The sections cited in the article (49 USC 5123 and 5124) are directed at businesses which transport hazardous materials as a part of their services. This falls under Subtitle III "General and Intermodal Programs" Chapter 51 "Transportation of Hazardous Materials." The FAA might be able to levy a small fine, but they would likely only do so in the event the flight was disrupted as a result of the phone catching fire.
