The FAA and NTSB should have been privy to the tapes immediately following the incident. Asking for testimony now is moot because they could have corroborated their stories. No drug or alcohol analysis of the blood was done, and most importantly, no cvr, cdr data. Who cares what testimony the crews had time to contrive; any sweet spot of opportunity to learn was lost as the crew is now uncooperative with the investigation thus triggering a subpoena. Why does it matter now, but not then when the data was fresh?

Without accurate information about what happened, the NTSB won't be able to correctly determine what needs to change to prevent future incidents. AA should have brought the flight back to the gate and protected the recordings and other information.

Two things, once they took off the cockpit voice recorder re-recorded over the incident. The crew had the ability to say they were unfit to fly due to the circumstances which they should have done.
